South Beach restaurant auto-gratuity + tip line
18–20% auto-added; the receipt then asks for another 20%.
How it works
Ocean Drive and Lincoln Road restaurants routinely add an 18–22% auto-gratuity for parties of 2+, hidden in fine print. The tip line on the receipt then suggests 20–25% on top — many tourists double-tip. Some servers also swap the receipt.
How to avoid it
- Read the bottom of the menu for 'gratuity added' — it must be disclosed under Florida law.
- Check the itemised bill for 'gratuity', 'service charge', or 'auto-grat' before signing.
- Cross out the tip line on the merchant copy after signing.
If it happens: do this now
- Ask the server to remove double-tips — most will.
- If refused, complain to the manager; if still refused, dispute with your card issuer within 60 days.
- File with FL Attorney General (myfloridalegal.com) for repeated offenders.
Jet-ski 'damage' claim on South Beach
Rental returns fine; operator invents $500–$2,000 in 'damage' and charges the card on file.
How it works
Freelance jet-ski operators on South Beach take your card as deposit, then bill for pre-existing scratches or invent 'motor damage' after your ride. Complaints to FL Consumer Services list dozens of Miami operators.
How to avoid it
- Rent only from established marinas (Boucher Brothers, licensed hotel rentals).
- Photograph and video the entire ski (all sides + engine) before AND after your ride, timestamped.
- Refuse to hand over your credit card if they demand it as 'deposit' rather than for the rental cost.
If it happens: do this now
- Dispute the extra charge with your card issuer — send your photos and video.
- Report to Miami Beach Police (305-673-7900) and Florida Department of Consumer Services (fdacs.gov).
- File complaint with FL Attorney General.
Unmetered taxi from MIA airport
Driver refuses meter, quotes $80 flat for a $30 metered trip.
How it works
MIA taxi rates are metered inside Miami-Dade or flat-rate to specific zones (Miami Beach flat is $35). Some drivers refuse the meter for out-of-zone trips or claim the meter is broken. Others use unofficial 'taxis' that are just black cars with no plates.
How to avoid it
- Use the official taxi rank; insist on the meter or the posted flat rate.
- Uber / Lyft pickups at MIA are at Level 3 (departures) or the transportation deck.
- Metro Rail airport station to Downtown is $2.25.
If it happens: do this now
- Refuse the trip if meter is refused; photograph medallion.
- Report to Miami-Dade Consumer Services 311 or (786) 469-2300.
- Dispute card charge within 60 days.
Club VIP 'host' bait
Promoter promises 'free VIP entry'; $500 bottle minimum inside, no exit until paid.
How it works
Club promoters outside LIV, Story, and Booking-only clubs offer 'free VIP' or 'complimentary bottle service.' Inside you're seated at a table with a $500–$1,500 minimum you didn't agree to. Card is run for the full amount before you can leave.
How to avoid it
- Ignore promoters offering 'free' bottle service — nothing is free at Miami clubs.
- Book table directly with the club, in writing, with total confirmed in advance.
- General admission tickets are cheaper (Eventbrite, Discotech).
If it happens: do this now
- Refuse to sign a bill for items you didn't order.
- Dispute card charge within 60 days — Miami clubs are on Visa/Mastercard high-risk lists.
- Report to Miami Beach Police and FL Attorney General.
Timeshare 'free breakfast / cruise' pitch
'90-minute presentation' becomes 5 hours of high-pressure sales you can't leave.
How it works
Offers at MIA arrivals, cruise ports, and Ocean Drive kiosks pitch 'free tickets to attractions' in exchange for a '90-min presentation.' Reality: 4–6 hours of pressure to buy a $30k–$60k timeshare, and 'free' gifts often require another purchase to claim.
How to avoid it
- Skip all 'free' offers requiring a presentation.
- Real Miami attractions sell tickets at gate for less than the 'time value' of a presentation.
- Never share credit card or ID at a kiosk.
If it happens: do this now
- Florida law gives you 10 days to rescind a signed timeshare contract in writing — use it.
- File complaint with Florida DBPR (myfloridalicense.com) and FL AG.
